These Terms of Service (“Terms”) govern your access to and use of the website located at waterstonecompanies.com and any related pages, content, features, and services (collectively, the “Site”) operated by Waterstone Companies, LLC (“Waterstone Companies,” “we,” “us,” or “our”). By accessing or using the Site, submitting a lead form, requesting an estimate, calling our business, or sending us a text message, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About Waterstone Companies

Waterstone Companies, LLC is a design-build remodeling contractor headquartered in Alabama. We provide residential construction and remodeling services, including roofing, decks, fencing, sunrooms and pergolas, siding and gutters, patio covers and carports, and interior finish work. The Site is a marketing and lead-generation website; no products or services are purchased directly through the Site.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Site or to submit a form, request an estimate, or otherwise communicate with us through the Site. By using the Site, you represent and warrant that you meet these requirements and that all information you provide is true, accurate, current, and complete.

3. Informational purpose only; not a contract for services

The content on the Site, including descriptions of our services, photographs, project galleries, testimonials, pricing ranges (where shown), service areas, warranty summaries, and FAQ responses, is provided for general informational and marketing purposes only. Nothing on the Site constitutes an offer, a quote, a bid, or a contract for construction services. A binding agreement for services is formed only when Waterstone Companies and a customer sign a written contract specific to the project.

4. Lead-form submissions and contact

When you submit a contact or lead form on the Site, request an estimate, or otherwise initiate contact with us, you authorize us to contact you in response at the phone number, email address, and mailing address you provide. You agree that:

  • The information you submit is truthful and belongs to you (or you have the authorization of the person it belongs to).
  • You are the subscriber or customary user of the phone number you provide.
  • We may contact you by phone, email, or SMS to respond to your inquiry and to coordinate design consultations, estimates, and project work.
  • Submitting a form does not create an obligation on either side; it initiates a conversation about whether your project is a good fit.

If you do not want to be contacted, do not submit a form.

5. SMS / text messaging

By checking the SMS consent box on our website forms, by texting us first, or by otherwise opting in, you consent to receive SMS text messages from Waterstone Companies, including appointment reminders, quote and project updates, missed-call text-back responses from our business line, customer-care messages, and — if you have separately consented — promotional messages. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, and you can get help by replying HELP. 6. Carrier Liability

7. Intellectual property

All content on the Site — including text, graphics, logos, photographs, videos, project galleries, designs, layout, look and feel, and the Waterstone Companies name and marks — is the property of Waterstone Companies, LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, personal, non-exclusive, non-transferable, revocable license to access and view the Site for your personal, non-commercial use. You may not reproduce, republish, distribute, modify, create derivative works from, publicly display, frame, scrape, or otherwise exploit any Site content without our prior written permission, except that you may print or save individual pages for your personal reference.

Third-party product names, brand names, and logos that appear on the Site (for example, Trex, TimberTech, James Hardie, Temo) are the trademarks of their respective owners and are used for informational purposes only.

8. Your submissions and user content

Any feedback, suggestion, comment, testimonial, photograph, review, or other content you voluntarily submit to us (“Submissions”) is not confidential. By sending us a Submission, you grant Waterstone Companies a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, and display the Submission in connection with our business and marketing. You represent that you own or have the necessary rights to grant this license and that your Submission does not violate any third-party rights.

9. Acceptable use

When using the Site, you agree not to:

  • Violate any applicable law or regulation
  • Submit false, misleading, or fraudulent information
  • Infringe on the intellectual property or privacy rights of any person
  • Transmit any virus, malware, or other harmful code
  • Attempt to gain unauthorized access to the Site, our servers, or any connected systems
  • Interfere with or disrupt the operation of the Site, including by scraping, data-mining, or sending automated queries
  • Impersonate any person or misrepresent your affiliation with any person or entity

THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS PROVIDED ON OR THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WATERSTONE COMPANIES DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any information on the Site is accurate, complete, reliable, or current.

This Section 11 applies to the Site only. Any warranty related to construction services Waterstone Companies actually performs for you is set forth exclusively in the written contract and warranty documents for that specific project, and is not altered by these Terms.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WATERSTONE COMPANIES, ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL THE TOTAL LIABILITY OF WATERSTONE COMPANIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Waterstone Companies, its members, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any law or the rights of any third party, or (d) any content you submit to us.

14. Modification of the Site

We may modify, suspend, or discontinue the Site (in whole or in part) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Site.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will take effect when the revised Terms are posted. Your continued use of the Site after the revised Terms are posted constitutes your acceptance of the changes. If you do not agree to the revised Terms, stop using the Site.

16. Governing law and venue

These Terms and any dispute arising out of or relating to them or your use of the Site are governed by the laws of the State of Alabama, without regard to its conflict-of-law principles. You agree that any dispute will be brought exclusively in the state or federal courts located in the State of Alabama, and you consent to the personal jurisdiction of those courts.

17. Severability and waiver

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. A failure by Waterstone Companies to enforce any provision of these Terms is not a waiver of that provision or of any other provision.

18. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Waterstone Companies regarding your use of the Site, and supersede any prior agreements between you and Waterstone Companies regarding your use of the Site. These Terms do not govern construction services actually performed by Waterstone Companies, which are governed exclusively by the separate written contract for that project.
